Resident Rights

To provide an environment that respects and protects the rights of our patients and their families, we provide this listing of patient rights and responsibilities. A complete copy of these rights, and/or the resident rights afforded under State law, may be obtained from the business office.

Resident Rights - Federal

  • The Resident has a right to a dignified existence, self-determination, and communication with and access to persons and services inside and outside the Center. A Center must protect and promote the rights of each Resident.
  • The Resident has the right to exercise his or her rights as a resident of the Center and as a citizen or resident of the United States.
  • The Resident has the right to be free of interference, coercion, discrimination, and reprisal from the Center in exercising his or her rights.
  • The Resident has the right to refuse treatment, to refuse to participate in experimental research, and to formulate an advance directive.
  • The Center must inform each resident of the name, specialty, and way of contacting the physician responsible for his or her care.
  • The Resident has the right to manage his or her financial affairs, and the Center may not require residents to deposit their personal funds with the Center.
  • The Resident has the right to choose a personal attending physician.
  • The Resident has the right to personal privacy and confidentiality of his or her personal and clinical records.
  • The Resident has the right to voice grievances without discrimination or reprisal. Such grievances include those with respect to treatment which has been furnished as well as that which has not been furnished.
  • The Resident has the right to examine the results of the most recent survey of the Center conducted by Federal or State surveyors and any plan of correction in effect with respect to the Center. The Center must make the results available for examination in a place readily accessible to residents, and must post a notice of their availability.
  • The Resident has the right to privacy in written communications, including the right to send and promptly receive mail that is unopened.
  • The Resident has the right to have reasonable access to the use of a telephone where calls can be made without being overheard.
  • The Resident has the right to retain and use personal possessions, including some furnishings, and appropriate clothing, as space permits, unless to do so would infringe upon the rights or health and safety of other residents.
